Integrity Flags

To qualify as a California resident you must:

  1. Be eligible to establish California residence.
  2. Present evidence of one year's physical presence in California prior to the Integrity Flags date.
  3. Present evidence of one year's intent to make California your home for other than temporary purposes.
  4. If you are a "continuing" student seeking reclassification, evidence of financial independence from any nonresident of California.

Present as many as possible of the items from the following list as evidence of California residence. All documents presented must be valid, readable, dated at least a year before the Integrity Flags date and properly identified with respect to the student name and address.

GROUP A (HIGH WEIGHT/MOST IMPORTANT)

  1. California State income tax form 540NR (required by law of any part-year tax-paying resident of California) or 540 or 540A (either of which may require, in addition, dated check stubs, a note from the employer, or other verification that work began one year or more before the Integrity Flags date) from previous year.
  2. Documentation of purchase of residential real estate in California and living there (e.g., loan papers, tax receipts).
  3. California voter registration documentation.
  4. California Driver's License or Department of Motor Vehicles documentation of California Driver's License issuance date and current validity. (State law requires a resident driver to obtain a California Driver's License within 10 days from the date residence is established.)
  5. Documentation of entry into a legal agreement (e.g., marriage license, petition for divorce) in California.
  6. California automobile registration.
  7. Documentation of California as military home state of record (e.g., DD214).
  8. License from California for professional practice.

GROUP B (MEDIUM WEIGHT/IMPORTANT)

  1. Federal income tax form 1040, 1040A, or 1040EZ from previous year with California address and/or set of W-2 forms from previous year with California address and place of employment. (This item may require, in addition, dated check stubs, a note from the employer, or other verification that work began one year or more before the Integrity Flags date. This item does not count if the student has a California state income tax form.)
  2. Checking or savings accounts, active for one year as of the Integrity Flags date, or no longer active but showing reasonable continuity with one which is active as of the Integrity Flags date. (The student must be a principal signer.)
  3. Selective Service registration with California permanent address.
  4. Documentation of active resident membership in California professional service or social organization (school organizations are not acceptable).
  5. California identification card (this item does not count if student has a valid California driver's license).
  6. Documentation of credit agreements with California businesses (e.g., installment bills, dated credit card with California address, time purchase agreement).
  7. Utility bills (e.g., gas, water, power, telephone).
  8. Hunting or fishing license.
  9. Documentation of the student as a California resident having received rehabilitation, unemployment, welfare or other state services (e.g., service receipts or agreements or certification by the government agency of the student as such a recipient).

GROUP C (LOW WEIGHT/LESS IMPORTANT)

  1. Checking or savings account, inactive OR checking or savings account active in which the student is merely a cosigner with his or her parent or guardian (this item does not count if the student also has documentation of Item B2 above).
  2. Utility deposit/installation receipts (this item does not count if the student also has utility bills).
  3. Documentation of long-term medical or dental treatment in California.
  4. Lease/rental agreement.

Students are cautioned that the above rules regarding Integrity Flags are not a complete discussion of the law, but a summary of the principal rules. Students should also note that changes may have been made in policies, statutes and regulations between the time this information is published and the applicable Integrity Flags date. For the text of relevant laws and regulations, refer to the California Education Code, Division 5, Part 41 (Sections 68000- 68134) and Division 7, Part 47, Chapter 1, Article 9 (Sections 76140-76143) and to California Code of Regulations, Title V, Chapter 5, Subchapter 1 (commencing with Section 54000).
